The Failure of the 28-Point Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the crisis sparked by the presentation of a new comprehensive peace framework for resolving the conflict appeared – briefly – to have been contained. A senior US official spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of opposing developments captured the harsh reality of the outgoing year. By day, diplomatic battles are waged: hopeful statements are issued from various governments. Considerable effort is allocated on managing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "resolution".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is capable of detecting missile launches from enemy soil, a ability enabled by current data. From witness perspectives, Ukrainian air force fighter jets that had been deployed to engage hostile aerial threats flew past – sophisticated military planes supplied to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems activated: multiple launches fired to intercept a hostile projectile. This was a modern interception technology at work, probably provided by allied countries. Every deployment shakes the surroundings, shaking the windows. The brief panic quickly transforms into grim resignation: perhaps the approaching threat won't strike its target this time, sparing the city from devastation and further power outages.

Persistent Threats

Soon after, a automatic firearm opened up on a unmanned aircraft close by, part of a defensive team – most likely Western-made equipment. Unfortunately, the bullets missed the opposing UAV – it pressed on overhead toward its objective.

Intermittently, this carried on until dawn. Kyiv greeted the early updates: multiple fatalities, destruction and infrastructure problems in numerous residences as a result of the evening attack. As always, everyone still continued their routines – living the war. But those entire period demonstrated Ukraine's essential dependence on external assistance – a need that neighboring countries are clearly incapable to fill in the short term.

Unsuccessful Negotiations

The detailed framework from American leadership generated strong feelings, discussion and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new initiative from US leadership adheres to the identical sequence: a negotiation push against Ukraine, which Kyiv, with partner nations, manages to fend off. They manage the tension but never actually secure success. This pattern will, no doubt, continue.

Tactical Assessments

It is convenient to criticize specific actors of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. US administration operates on a assumption familiar among international relations experts: you cannot achieve through diplomacy what you have lost on the battlefield. The US administration assumes that it is unfeasible to pressure the Kremlin to surrender the areas that it already controls in Ukraine's southern or eastern regions.

The problem is that while recognising this factual reality, American administration does little to discourage Russia, through statements or actions, from believing that the status quo will not change more in its advantage in the coming year.

Opposing Positions

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its allies are coming close to fatigue. Their incentive to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be many attempts to stop fighting, but they will continue as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, progressively conceding civilians and areas but preventing a entire defensive failure until circumstances change in its benefit.

Present Conditions

Realistically, there are no real preconditions for a armistice. Now, subjective factors are becoming relevant: leadership ambitions to broker a ceasefire and secure international recognition, and the government's dual difficulties – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the country's interests against any initiative Kyiv finds unacceptable, so that their focus does not switch to domestic problems. And although their task will now be significantly challenging after current events, it remains quite doubtful that this will alter their fundamental strategy.

These two forces are driving the talks.

Conclusion and Outlook

It took a just a single week to terminate the suggested clauses of the current initiative. Assertive and inconsistent approach of the matter by US administration, resistance by Ukraine and the rest of Europe, along with soothing efforts of diplomats, and finally, latest revelations, all served their function.

While new proposals based on established approaches are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and show specific hesitation to alter the situation, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, mainly require continued Western support.
